Eviction Procedure

• When the Clerk of Court receives a ruling on a Forcible Entry & Detainer action in the Plaintiff’s favor, THEY (the Plaintiff) will need to request that the clerk issue a WRIT OF POSSESSION to the Sheriff. It will not be done automatically.
• After the WRIT OF POSSESSION is issued, the PLAINTIFF will need to contact the Civil Division at 319-642-3496, Monday through Friday between the hours of 8:30 a.m. – 4:30 p.m. to schedule an EVICTION time in agreement with the staff. We will not schedule an eviction for the same day you contact our office and no evictions will be scheduled on the weekend.   
• The SHERIFF will deliver a copy of the WRIT along with a COURTESY LETTER stating the date of the eviction to the address of the defendant. It is NOT NECESSARY to serve this letter on the defendant, it may be posted on the door if no one is available to receive it.  
• At the time of the EVICTION, it is expected the Plaintiff provide enough manpower to complete the eviction in approximately 1 hour. The Sheriff’s function is to provide the authority, keep the peace, and direct the procedure. If there is not enough help present, the Deputy may choose to reschedule. The eviction may also be postponed by the Sheriff if weather conditions are inclement.
• The Plaintiff will be required to move all of the property from within the residence to the curb or nearest public property. If the DEFENDANT VACATES voluntarily, it is up to the Plaintiff to decide if they want to have our office stand by while any remaining property is removed. If the eviction procedure is cancelled, the Plaintiff accepts any liability for any property left behind. 

Fees

• OUR FEES for a WRIT OF POSSESSION (eviction) are $30.00 PLUS mileage and officer time of $30.00/hr.
